L’ambition de ces deux rencontres est de contribuer à combler une lacune historiographique en nouant un dialogue entre les études historiques – où l’on observe depuis longtemps un regain d’intérêt pour l’étude des relations internationales et, en particulier, pour la diplomatie à la fin du Moyen Âge et au début de l’époque moderne – et les études relevant de l’histoire du droit, en particulier l’histoire de la pratique et de la doctrine médiévale du droit des gens.

In a broader perspective than that, strictly, of international business law or even of international trade law, this 5th international conference in the Kazakh-Franco-Korean series, aims to mobilise analyses drawing from legal sciences and the social sciences at large. International economic law encompasses both public law and private law, holistically, by contrast with academic traditions, for example French, where this duality of public and private law acts as a summa divisio of law scholars and research institutes.

Trust, transnationalisation and dispute resolution
L'objectif de ce colloque est de rassembler des académiques de divers champs scientifiques afin de cerner les enjeux contemporains de la confiance (et de son contraire, la méfiance) pour la régulation des rapports sociaux. De nouveaux problèmes de régulation, nés de la transnationalisation et de la réticularisation, témoignent de cette importance de la confiance. Ainsi en va-t-il des litiges familiaux (éloignement d’enfants, adoption), des litiges financiers et commerciaux, du recours au soft law, etc. – la pandémie actuelle en a tout récemment offert certains exemples. Nous voulons dès lors, à l’occasion de cette conférence, clarifier et conceptualiser le recours contemporain à la notion de confiance sur les plans sociologique, juridique et politique.

Bien que les recherches juridiques qui visent à théoriser pourquoi et quand les états se conforment au droit international aient été prolifiques, il n’existe pas d’entente sur une théorie cohérente de la conformité. La doctrine des théories de la compliance embrasse toutes sortes de domaines empiriques en droit international. Le droit international des droits humains constitue un domaine important d’études conceptuelles et empiriques sur le sujet.

Mixed arbitral tribunals, 1919–1930
An experiment in the international adjudication of private rights
The creation of a system of Mixed Arbitral Tribunals (MATs) was a major contribution of the post-WWI peace treaties to the development of international adjudication. Numerically speaking, the 36 MATs were undoubtedly the busiest international courts of the interwar period. Taken together, they decided on more than 70,000 cases, mostly covering private rights. The MATs are similarly remarkable from a procedural point of view. First, their respective rules of procedure were so detailed that contemporaries described them as 'miniature civil procedure codes'. Second, in a departure from most other international courts and tribunals, they also allowed individuals whose rights were at stake to become involved in the proceedings before them.

Le projet de recherche INSIDE (International Socialization and Democracy Through International Law) : l’idée que le droit international est un outil de socialisation des États est le postulat du Projet. La doctrine tente d’identifier, en invoquant à la fois les théories des relations internationales et celles du droit international, les causes et les conséquences de cette socialisation. La recherche que nous menons au sein du projet trouve ses fondements dans ce contexte et repose sur le vaste champ empirique du droit international des droits humains. L’un des objectifs du projet est de construire des outils d’analyse de nature à pouvoir évaluer et mesurer le respect des engagements pris par les États.

Next year will mark the 50th anniversary of Greece’s withdrawal from the Council of Europe, following pressure by European countries and institutions for the violation of human rights by the military junta in Greece (1967–74). The Athens-based Netherlands Institute and the Danish Institute, in collaboration with the Swedish Institute and the Norwegian Institute are organizing an international conference on the history and legacy of this emblematic case.

Maritime realities and imaginations in the Indian Ocean

The main thrust of this third issue of Les Carnets is the oceanic interface of the Indian Ocean, as both a real and an imagined space. While academic inquiry haslargely focused on its resources and marine reserves, this third issue of Les Carnets endeavours to widen the existing perimeter and bring together texts that shed new light on the maritime dimension of the Indian Ocean. We welcome proposals in the areas ofgeography, law, history, literature, linguistics, and economics. Can we say that there is a distinct community of Indian Ocean inhabitants sharing values and interests as well as a common past that distinguish them from the other societies in their respective continents? Are there realities and a common imaginary for the peoples of this marine expanse? Or on the contrary, given the immensity of the Indian Ocean, would it seem that specificities and peculiarities dominate and fragment, overshadowing such a hypothesis ?

Models and Transformations, from Confessional States to Religious Freedom
This conference will explore the international legal agreements signed between the Holy See and individual states, which often but not always took the form of concordats and similar conventions. Its central focus will be to examine these conventions in light of diplomatic practices, as well as in relation to the political and religious dynamics of the nineteenth through the twenty-first centuries, notably the principles and requirements that comprised modernity. This entails assessing the historical evolution of the typology, method, content, scope, and spaces concerned.

The Human Sea European research Council program aims to respond to the problems related to the development of human activities at sea, which lead progressively to a transformation of the law of the sea and maritime law, and remain today legally little framed. The objective of the Human Sea program, led by Patrick Chaumette, Professor of Law at the University of Nantes and former director of the Center of Maritime and Oceanic Law (CDMO), is to rethink the concepts born of the history of maritime activities and navigation and to question the intervention of States at sea, from their territorial waters to the high seas. The compromises reached in 1982 with respect to the law of the sea will also be examined in the light of threats and new techniques.

L’ambition de ce colloque est non seulement de revenir sur les aspects méconnus de la vie et de l’œuvre de Joseph-Marie Portalis dans une perspective interdisciplinaire en confrontant les approches des juristes, politistes et historiens, mais également de mettre à profit des documents d’archives inédits déposés depuis 2012 à la Cour de cassation, aux Archives nationales, aux Archives du ministère des Affaires étrangères et aux Archives départementales des Bouches-du-Rhône et du Maine-et-Loire.
