Actions, objects, relations: an interdisciplinary perspective

Cet atelier doctoral vise à dégager des pistes pour repenser la citoyenneté en Méditerranée, en désincrustant celle-ci des essentialisations culturelles, des épistémès disciplinaires, et des traditions historiographiques nationales. Il part d’une définition large de la citoyenneté, qui ne se restreint pas à l’obtention d’un statut conditionnant l’exercice de droits politiques, mais qui prend en compte les processus de construction des droits d’accès aux ressources locales (telles que le travail, le logement, l’assistance etc.). En adoptant une perspective interdisciplinaire, ce projet veut faire dialoguer, à partir de terrains géographiques et d’époques différentes, des conditions d’affirmation citoyenne formalisées par l’inégal droit d’accès aux ressources locales.

The legal personality of the animal (II)

Domestic animals

2015 February 16 n°2015-177 Act defines animals as “living beings endowed with sensibility” while submitting them to the property regime “subject to provisions regarding their protection”. To deal with this incoherence, we recommend rebuilding the category of the persons, legally speaking, in order to integrate animals. The law differentiates natural persons and legal persons. We suggest integrating animals into the category of natural persons by distinguishing precisely between human persons and non-human persons. This doctrinal proposition would allow animals to be granted, with their new legal personality, a coherent and efficient status. The first edition dealt with pet animals. This present session focusses on other types of domesticated animals, including not only livestock, but also animals used for entertainment and laboratory testing. Wild animals will be covered by the third and final session, which will conclude the trilogy of colloquia organised by the University of Toulon on the legal personality of animals.
