Le célèbre ouvrage Law, Liberty and Morality (1963) du philosophe du droit britannique H.L.A. Hart (suivi peu de temps après par The Morality of the Criminal Law) demeure largement inconnu en France. Il s’agit cependant dans le monde anglo-saxon d’un ouvrage incontournable autant pour les juristes que pour les étudiants en science politique ou en histoire contemporaine. Ce recueil de conférences a structuré le débat sur la libéralisation de l’homosexualité dans la décennie qui a mené au printemps de 1968, et a propulsé Hart à la position de véritable « public intellectual ». Bien au-delà, c’est la contribution de ce grand juriste à un domaine d’étude parfois mal considéré sur le continent qui pourra retenir notre attention.
Hart a pu consacrer d’autres écrits à une analyse du phénomène juridique proprement dit, et à une reformulation – au sein d’une culture de common law – du programme du positivisme juridique. Il admet entre autres que le droit peut en tant que tel avoir n’importe quel contenu. En séparant le droit de la morale, Hart exclut ainsi la possibilité d’inclure une contrainte substantielle au sein d’une définition du droit positif. Cependant, Hart a consacré une partie de son œuvre – dont Law, Liberty and Morality ainsi que The Morality of the Criminal Law – à la philosophie morale en étudiant longuement, à la différence de Kelsen, les zones obscures entre droit et morale. Il ne s’est pas contenté de donner une définition purement négative de cette dernière (comme toute normativité ne rentrant pas dans la catégorie du droit), et est parti du postulat qu’identifier la nature propre du droit passe nécessairement par une identification du contenu des domaines avec lesquels on cherche à le faire entrer en contraste. Qui plus est, Hart s’est livré à une véritable critique morale du droit positif, critique justifiée selon lui par le fait que le législateur entend précisément donner à certaines normes un contenu moral, contenu qui doit faire l’objet d’une évaluation et d’une justification de la part de celui dont le rôle est justement de se préoccuper de la vie du droit (on sent peut-être ici l’influence de la common law sur la pensée de Hart). Le juriste ne peut pas ainsi faire l’économie du développement d’une philosophie morale, et ce parce qu’il en va de la maîtrise de son objet d’étude premier : le phénomène juridique. Le positivisme juridique hartien consiste donc bien en une séparation conceptuelle stricte du droit et de la morale, mais n’entraîne pas les implications programmatiques des travaux de positivistes continentaux qui se centrent autour de la notion de science du droit.
Dans le cadre de la présentation de la traduction française des textes de Hart évoqués ci-dessus, à paraître à l’occasion du cinquantième anniversaire de Law, Liberty and Morality, nous nous proposons de consacrer une journée d’étude à cette partie méconnue de l’œuvre de H.L.A. Hart. Nous présenterons et discuterons l’ouvrage en question au cours de la matinée. L’après-midi sera consacrée plus généralement au thème de la séparation du droit et de la morale dans le positivisme juridique hartien.

Argument
H.L.A. Hart’s famous book Law, Liberty and Morality (1963) – followed shortly after by The Morality of the Criminal Law – remains to a large extent unknown in France. In the Anglo-Saxon world, however, it is essential reading for students in the fields of law, political science, and contemporary history. This cycle of conferences (The Hamlyn Lectures), structured around the theme of the liberalisation of homosexuality in the decade which would lead up to the events of the spring of 1968, catapulted Hart to the status of public intellectual. Besides its historical importance, it represents the contribution of this great legal philosopher to an area of study which is often overlooked on the Continent.
Hart devoted other major works to an analysis of the legal phenomenon properly understood, and to a reformulation of the programme of legal positivism within a common law culture. He thus championed the idea that positive law can bear any content – however immoral – and remain good law ; and by operating a separation of law and morals he excluded any possibility of an element of content in the definition of positive law. Having said that, Hart - unlike Kelsen - devoted a large part of his work (including Law, Liberty, and Morality and The Morality of the Criminal Law) to moral philosophy and to an elucidation of the grey areas at the intersection of law and morals. He thus did not limit himself to a purely negative definition of morality (as a form of normativity which does not fall within the category of law), and proceeded on the assumption that an identification of the true nature of the legal phenomenon would have to include an examination of the characteristics of the neighbouring areas with which we seek to contrast law. Moreover, Hart developed a veritable moral critique of positive law. This critical morality aimed to provide standards of justification which would have to be met by legal norms, so many of which were actually designed by the legislature or the judge to bear moral content. Lawyers – who are properly concerned with the life of the law (and this may be one of the points where we feel the influence of the common law on Hart’s legal theory) – require standards of evaluation and justification for the moral content of law, where it happens to carry one. For all these reasons, it seems that a study of moral philosophy is essential to a jurist’s grasp of his proper field of study : the legal phenomenon. Hartian legal positivism does therefore consist of a strict conceptual separation of law and morals, but does not carry the programmatic implications of the works of continental positivists centred – following on from Kelsen – around the notion of a restrictive science of law.
To mark the translation into French of the above mentioned works of H.L.A. Hart at the intersection of legal and moral philosophy, and to commemorate the fiftieth anniversary of Law, Liberty, and Morality (in 2013), this symposium will be dedicated to this greatly overlooked dimension of Hart’s oeuvre. The book in question will be presented and discussed during the morning session. The afternoon session will seek out a more general understanding of the separation of law and morals in hartian legal positivism.
